Article 6    Where a high-rise civil building is used by the contractor, lessee or operation manager in the form of contract, lease or entrusted operation and management, the parties shall clarify the fire safety responsibilities of each party when signing the contract for contract, lease or entrusted management

Article 11    Fire rescue institutions and other institutions responsible for fire supervision and inspection shall carry out fire supervision and inspection on high-rise civil buildings according to law, and urge owners, users and entrusted fire service units to implement fire safety responsibilities; For fire hazards found in supervision and inspection, notify relevant units or individuals to take immediate measures to eliminate them

.

If a realty service enterprise is entrusted or a unified manager is specified to implement fire safety management, the realty service enterprise or the unified manager shall perform the fire safety responsibilities specified in the preceding paragraph in accordance with the agreement, and the owner and user units shall urge and cooperate with the realty service enterprise or the unified manager to do a good job in fire safety

.

Article 7    The owners and users of high-rise public buildings shall perform the following fire safety responsibilities: (1) abide by fire control laws and regulations, and establish and implement fire safety management system( 2) Specify the fire safety management organization or fire safety management personnel( 3) Organize fire patrol and inspection to eliminate potential fire hazards in time( 4) Ensure that the evacuation passage, emergency exit and fire truck passage are unblocked( 5) Regularly inspect and maintain the building fire-fighting facilities and equipment to ensure that they are intact and effective( 6) Organize fire protection publicity, education and training, formulate fire fighting and emergency evacuation plans, and regularly organize fire drills( 7) Establish full-time fire brigade, voluntary fire brigade (Micro Fire Station) and other fire organizations according to regulations( 8) Other fire safety responsibilities stipulated by laws and regulations

The entrusting party and the lessor may, in accordance with the law, uniformly coordinate and manage the fire safety work of the contractor, the lessee and the entrusted party

.

Article 8    The owner, user, property service enterprise or unified manager of a high-rise public building shall designate a special person to act as the fire safety manager, be responsible for the fire safety management of the whole building, and publicize his name, contact information and fire safety management responsibilities in a prominent position of the building

.

Article 3    The fire safety management of high-rise civil buildings implements the policy of putting prevention first and combining prevention with fire prevention, and implements the fire safety responsibility system

.

Article 5    If there are two or more owners and users in the same high-rise civil building, each owner and user shall be responsible for the fire safety of its proprietary part and jointly responsible for the fire safety of the common part

.

Article 9    The owners and users of high-rise residential buildings shall perform the following fire safety obligations: (1) abide by the fire safety matters agreed in the Convention on fire safety in residential areas and the management regulations( 2) Use the building according to the purpose specified in the real estate ownership certificate( 3) Cooperate with the fire service unit in fire safety work( 4) Bear the cost of fire service and the cost related to the maintenance, renewal and transformation of building fire-fighting facilities in accordance with the law( 5) Maintain fire safety, protect fire-fighting facilities, prevent fire, report fire alarm, and adults participate in organized fire fighting( 6) Other fire safety obligations stipulated by laws and regulations

Fire rescue institutions shall strengthen the publicity of fire safety laws and regulations of high-rise civil buildings, supervise and guide relevant units to do a good job in fire safety publicity and education of high-rise civil buildings.

For high-rise civil buildings with a building height of more than 100 meters, stricter fire safety management shall be implemented

The owners and users of high-rise civil buildings may entrust professional service units such as property service enterprises or fire technical service institutions (hereinafter referred to as fire service units) to provide fire safety services, and shall specify the specific contents of fire safety services in the service contract

If the owner or user of a high-rise civil building is a unit, its legal representative or main person in charge is the person in charge of fire safety of the unit

.

  Chapter II    Fire safety responsibilities Article 4    The owners and users of high-rise civil buildings are the main body responsible for the fire safety of high-rise civil buildings and are responsible for the fire safety of high-rise civil buildings

For high-rise public buildings with a building height of more than 100 meters, relevant units are encouraged to hire registered Fire Engineers at corresponding levels or personnel with intermediate or above professional and technical positions in related engineering as fire safety managers

Article 10    The entrusted property service enterprise of high-rise residential buildings shall perform the following fire safety duties according to law:      ( 1) Implement fire safety responsibilities, formulate fire safety system, and formulate annual fire safety work plan and organization guarantee scheme( 2) Specify specific departments or personnel responsible for fire safety management( 3) Regularly inspect and maintain the common fire-fighting facilities, equipment and fire-fighting signs in the management area to ensure that they are intact and effective( 4) Organize fire patrol and inspection to eliminate potential fire hazards in time( 5) Ensure that evacuation passages, emergency exits and fire truck passages are unblocked, and stop illegal acts such as occupying, blocking and closing evacuation passages, emergency exits and fire truck passages; If the stop is invalid, it shall be timely reported to the fire rescue organization and other relevant administrative departments for handling according to law( 6) Urge the owner and user to fulfill their fire safety obligations( 7) Regularly inform the owners’ committee, owners and users of the residential community where they are located of the fire safety situation and prompt the fire safety risks( 8) Organize and carry out regular fire protection publicity and education( 9) Formulate fire fighting and emergency evacuation plans, and regularly organize drills( 10) Other fire safety responsibilities stipulated by laws, regulations and the contract

The fire safety manager of high-rise public buildings shall perform the following fire safety management responsibilities: (1) formulate an annual fire safety work plan and organize the implementation of daily fire safety management( 2) Organize fire prevention inspection, patrol inspection and rectification of fire hazards( 3) Organize and implement the maintenance of fire-fighting facilities and equipment shared by buildings( 4) Manage fire organizations such as full-time fire brigade and voluntary fire brigade (Micro Fire Station)( 5) Organize fire safety publicity, education and training( 6) Organize the preparation of comprehensive fire fighting and emergency evacuation plans and carry out drills

.

When contracting, leasing or entrusting operation and management, the owner shall provide buildings that meet the fire safety requirements and urge the user to strengthen the fire safety management

.

If the same high-rise civil building has two or more owners and users, it shall jointly entrust the property service enterprise, or specify one owner and user as the unified manager to implement unified management on the fire safety of the common part, coordinate and guide the owners and users to jointly do a good job in the fire safety of the whole building, The fire safety responsibilities of all parties shall be agreed in writing

.

Article 2    These Provisions are applicable to the fire safety management of high-rise civil buildings (including high-rise residential buildings and high-rise public buildings) that have been completed and put into use according to law
